Terms of Service
These terms are an agreement between you and Void Meadow LLC about using Pumpkin Fit. Please read sections 4, 5, 13, 14 and 16: they cover health and safety, medications, our warranties and liability, and how disputes are resolved.
01The agreement
By creating an account or using Pumpkin Fit you agree to these terms and to our Privacy Policy. If you don’t agree, don’t use the app. “We” and “us” mean Void Meadow LLC, an Oregon limited liability company.
02Who can use it
You must be at least 16 years old and able to form a binding contract, and not barred from using the app under the laws that apply to you.
03Your account
Give accurate information and keep your password to yourself. You’re responsible for what happens under your account. Tell us right away if you think someone else has accessed it.
04Health and safety
Pumpkin Fit is a logging and planning tool, not a medical device, and it does not give medical, nutrition or fitness advice. Calorie estimates, one-rep-max estimates, progression suggestions, insights and patterns are arithmetic on the numbers you log and may be wrong. Don’t rely on them for medical decisions.
Exercise carries a risk of injury. Talk to a doctor before starting a new training or eating plan, especially if you have a health condition, are pregnant, or take medication. Stop if something hurts, and use proper form, spotters and equipment. You use Pumpkin Fit and do any activity it records or schedules at your own risk.
Pumpkin Fit is not for emergencies. If you think you’re having a medical emergency, call your local emergency number.
05Medications and shots
Medication logging lets you record what you take and remind yourself. It does not recommend, calculate or change doses, check interactions, or tell you what to take. Always follow your prescriber’s and pharmacist’s instructions. Injection site suggestions only remind you which site you used least recently.
Reminders can fail to arrive because of device settings, Focus modes, low battery, software updates or other reasons outside our control. Don’t rely on Pumpkin Fit as your only reminder.
06Your content
You own what you log and post. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process and display your content only as needed to run Pumpkin Fit, including showing it to the audiences you choose. The license ends when you delete the content or your account, except for copies other people saved before you deleted it and backups that expire on schedule.
When you save someone else’s workout, recipe, meal, meal prep or list, you get your own copy to use for your personal training and cooking.
07Community rules
Don’t use Pumpkin Fit to harass, threaten or impersonate anyone; post hateful, sexually explicit or illegal content, or anything involving minors in a sexual way; spam or advertise; share other people’s private information; or infringe anyone’s rights.
Don’t try to break, overload, reverse engineer or scrape the service, get around Pro or privacy limits, or access accounts or data that aren’t yours. We may remove content and suspend or close accounts that break these rules.
08Copyright complaints
If you believe content on Pumpkin Fit infringes your copyright, email legal@pumpkin.fit with: your contact details, the work you believe is infringed, where the content is in the app, a statement that you believe in good faith the use isn’t authorized, a statement under penalty of perjury that your notice is accurate and that you’re the owner or authorized to act for them, and your signature. We may close the accounts of repeat infringers.
09Pro subscriptions
Pro is an optional subscription sold through the App Store. The price and billing period are shown before you buy. Payment is charged to your Apple ID, and the subscription renews automatically unless you cancel at least 24 hours before the end of the current period in your Apple ID settings. Refunds are handled by Apple under its policies.
If Pro ends, you keep your data; Pro features stop working at the end of the paid period. We may change Pro features or prices, and price changes won’t apply until your next renewal after notice.
10Other services
Pumpkin Fit can work with Apple Health, Apple Watch, Calendar, Reminders and food databases such as USDA FoodData Central and Open Food Facts. Those services have their own terms, and we don’t control them or guarantee their data, including nutrition information.
11Changes to the app
We’re always working on Pumpkin Fit, so features may change, be added or be removed, and the service may sometimes be unavailable. We’ll try to give notice of changes that significantly affect you.
12Ending your account
You can delete your account at any time in Settings. We may suspend or close an account that breaks these terms or creates risk or legal exposure for us or others, and we’ll tell you why unless the law or safety prevents it. Sections that by their nature should survive (such as content licenses for saved copies, disclaimers, limits of liability and dispute terms) survive.
13Disclaimers
TO THE FULLEST EXTENT ALLOWED BY LAW, PUMPKIN FIT IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON’T PROMISE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED OR SECURE, THAT DATA WON’T BE LOST, OR THAT REMINDERS WILL ARRIVE.
14Limits on our liability
TO THE FULLEST EXTENT ALLOWED BY LAW, VOID MEADOW LLC AND ITS MEMBERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS OR GOODWILL, OR FOR PERSONAL INJURY OR HEALTH OUTCOMES RELATED TO EXERCISE, DIET OR MEDICATION, ARISING FROM YOUR USE OF PUMPKIN FIT. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR PUMPKIN FIT IN THE 12 MONTHS BEFORE THE CLAIM OR US$50.
Some places don’t allow these limits, so they may not fully apply to you. Nothing in these terms limits liability that can’t be limited by law, such as for gross negligence or willful misconduct.
15Indemnity
If you use Pumpkin Fit in a way that breaks these terms or the law, or infringes someone’s rights, you agree to cover the reasonable costs and losses that result for us, including legal fees, to the extent the law allows.
16Disputes
If you have a problem, email legal@pumpkin.fit first and give us 30 days to try to resolve it.
If we can’t, you and we agree that any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either of us may bring an individual claim in small claims court. You and we each waive the right to a jury trial and to take part in a class action or class arbitration. You can opt out of arbitration by emailing us within 30 days of first accepting these terms.
If you live in the European Union, the United Kingdom or another place whose laws don’t allow these terms, this section doesn’t take away the rights and courts your local law gives you.
17Governing law
These terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-law rules. Disputes not subject to arbitration go to the state or federal courts in Oregon, unless your local consumer law gives you the right to sue where you live.
18App Store terms
These terms are between you and Void Meadow LLC, not Apple. Apple is not responsible for Pumpkin Fit or its content, and has no obligation to provide maintenance or support for it.
If Pumpkin Fit fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Apple is not responsible for any claims relating to Pumpkin Fit, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection or privacy claims, or claims that it infringes someone’s intellectual property.
You confirm you are not located in a country subject to a US government embargo or listed as a prohibited party. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
19The rest
These terms and the Privacy Policy are the whole agreement between us about Pumpkin Fit. If part of them can’t be enforced, the rest still applies. If we don’t enforce something right away, we haven’t waived it. You can’t transfer these terms; we may transfer them as part of a merger or sale.
If we change these terms in a way that matters, we’ll tell you in the app before the change takes effect. Continuing to use Pumpkin Fit after that means you accept the new terms.
